Terms of Service

1. Agreement

By creating an account or using GimmePuffin, you agree to these Terms and the Privacy Policy. If you use GimmePuffin for a business, you confirm that you can bind that business. You must be 18 or older to create a coach account.

2. The service

GimmePuffin provides booking pages, scheduling, packages and credits, payments through Stripe, student management, messaging, file sharing, waivers and analytics for independent golf instructors. We may change or improve features over time.

3. Coach accounts

You are responsible for your account, keeping your sign-in secure, and the accuracy of your lessons, prices, availability and policies. You own your content and client relationships, and give us permission to host and process them to run the service.

You are responsible for having a lawful basis and any needed consent to store and message your students, and for your own cancellation, refund and waiver terms.

4. Plans, fees and billing

Plans include Free, Pro, Team and the Founding Instructor offer, at the prices shown on the billing page when you purchase. Paid plans renew automatically each month or year until cancelled. Cancelling takes effect at the end of the paid period unless stated otherwise.

A platform fee applies to bookings paid through GimmePuffin. It is shown on the billing page and plan and depends on your plan. Stripe's processing fees are separate and set by Stripe. Plan and seat changes may be prorated as shown before you confirm. Taxes may apply. Subscription refunds are given only where the app or law says so.

Founding Instructor is a one-time purchase for the lifetime Pro plan for as long as GimmePuffin offers the service and the account remains in good standing. It is limited in number and is not transferable.

5. Payments and Stripe Connect

Student payments go through Stripe. To receive payouts, you must accept Stripe's terms and complete its verification. GimmePuffin is not a bank. Stripe holds and pays out funds. Coaches are responsible for refunds, disputes and chargebacks on their lessons, and we may pass through amounts Stripe debits for them.

6. Students and bookings

When a student books, the agreement to attend, pay, cancel and receive any refund is between the student and coach under the coach's published policies. GimmePuffin is a technology provider, is not a party to the lesson, does not provide golf instruction, and does not guarantee any lesson or outcome.

7. Waivers and safety

Coaches may collect digital waivers. Golf involves physical risk. GimmePuffin provides the tool only. Coaches are responsible for their waiver content and legal effect and for safety at their lessons.

8. Acceptable use

• Do not use the service for unlawful, fraudulent, abusive or harmful activity.
• Do not upload malware or content you have no right to share.
• Do not scrape, reverse engineer, interfere with the service or use it to spam.

We may suspend or end accounts that break these rules.

9. Files and content

You are responsible for what you upload or send. We may remove content that violates these Terms or the law.

10. Availability and changes

We work to keep the service available but do not promise it will be uninterrupted or error-free. We may update these Terms. For material changes, we will give notice. Continuing to use the service means you accept the updated Terms.

11. Termination

You can cancel at any time from the billing page, stop using the service, and ask us to delete your data. We may suspend or end access for breach, non-payment or legal reasons. Sections that by their nature should survive, including fees owed, liability and disputes, survive termination.

12. Disclaimers and liability

The service is provided "as is" and "as available" without warranties to the extent the law allows. To the extent permitted by law, GimmePuffin is not liable for indirect, incidental or consequential damages or lost profits. Our total liability for any claim is limited to the fees you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.

13. Governing law

These Terms are governed by the laws of Puerto Rico and applicable United States federal law. Disputes will be brought in the courts located in Puerto Rico unless the law requires otherwise.
